Return Policy and Limited Warranty

Teforia 30 Day Satisfaction Guaranteed Return Policy:

If you are not satisfied with your purchase of the Teforia Infuser from Teforia Company (“Teforia”) for any reason, you have 30 days from the date you receive your Teforia Infuser to request a refund provided that you purchased the Teforia Infuser through the Teforia website (“Teforia Infuser”). If 30 days have gone by since you received your Teforia Infuser, unfortunately we can’t offer you a refund.

1. To qualify for a refund, all of the following conditions must be met:

•   You must request a Return Merchandise Authorization (“RMA”) from our customer service team within 30 days of the date on which you received the Teforia Infuser.

•   To request an RMA, you must contact our customer service team via our website at http://help.teforia.com or via email addressed to [email protected]

•   Any accessories, such as the carafe and the infusion globe, that were included with the Teforia Infuser you purchased must be included with your return.

•   Teforia requires that you furnish a receipt or proof of purchase in order to obtain an RMA.

•   The returned Teforia Infuser, including accessories, must be in good physical condition (not physically broken or damaged), in either the original packaging or packaging that provides an equal degree of protection.

•   The RMA number must be included along with your returned Teforia Infuser and written on the outside of the box and the Teforia Infuser must be sent to:

2. Additional Terms and Conditions

•   Shipping and handling charges, gift wrap fees, and taxes paid (e.g. state, customs, VAT) are not refundable.

•   You are responsible for and must prepay all shipping charges, and you shall assume all risk of loss or damage to the Teforia Infuser and accessories while in transit to Teforia. If you return a Teforia Infuser to Teforia (a) without an RMA from Teforia, or (b) without all parts and accessories included in the original package, Teforia retains the right to either (1) refuse delivery of such return or (2) charge you a restocking fee equal to the higher of fifteen (15) per cent of the original price of the Teforia Infuser or the retail value of the missing parts or accessories.

•   Because we don’t guarantee that we will receive the returned Teforia Infuser, we recommend that you use a trackable shipping service or purchase shipping insurance when you return the Teforia Infuser.

3. Refunds

•   Once your return is received and inspected, we will send you an email to notify you that we have received your returned Teforia Infuser. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 7-10 business days (the “Refund Processing Period”).

•   If you don’t receive a refund within the Refund Processing Period, please double-check with your bank or credit card issuer. If you’ve done this and still have not received your refund, please contact us at [email protected]

4. Gifts

•   If the Teforia Infuser was marked as a gift when purchased and shipped directly to you, you will receive a gift credit for the value of your return. Once the returned Teforia Infuser is received, a gift certificate will be mailed to you.

•   If the Teforia Infuser was not marked as a gift when purchased, or the gift giver had the order shipped to himself or herself to give to you later, we will send a refund to the gift giver.

Limited Warranty for Teforia Infuser

Teforia warrants to the original purchaser only that the Teforia Infuser, other than the carafe and infusion globe, whether included with the Teforia Infuser or purchased separately (each, an “Accessory” and together, the “Accessories”) (the Teforia Infuser excluding the Accessories included with the Teforia Infuser is referred to in this Limited Warranty as the “Teforia Infuser”) you purchased shall be free from defects in materials and workmanship under normal use for a period of two years after the date you receive your Teforia Infuser or 3,000 uses (full carafes brewed), whichever comes first (the “Teforia Infuser Warranty Period”). Teforia warrants to the original purchaser only that the Accessories included with your Teforia Infuser, or purchased separately, shall be free from defects in materials and workmanship under normal use for a period of one year after the date your receive such Accessory or Accessories or 1,500 uses, whichever comes first (the “Accessory Warranty Period”).

1. Remedies

If a defect arises and a valid claim is received by Teforia within the applicable Warranty Period, Teforia will, at its option and to the extent permitted by law, either (a) repair the defective Teforia Infuser or Accessory at no charge, using new or refurbished replacement parts, or (b) exchange the defective Teforia Infuser or Accessory with a new or refurbished Teforia Infuser or Accessory. If Teforia, in its sole discretion, determines that it is not reasonable to replace the defective Teforia Infuser or Accessory, Teforia may refund to you the purchase price paid for the Teforia Infuser or Accessory. To the extent permitted by law, these are your sole and exclusive remedies for any defect in the Teforia Infuser or Accessories. This Limited Warranty is valid for purchasers of the Teforia Infuser or Accessories who reside and use their Teforia products in the United States. Any repaired or replacement Teforia Infuser or Accessory will be warranted for thirty (30) days, or for any additional period of time remaining on the original warranty, whichever is longer.

2. How to Obtain Warranty Service

•   You must request a Return Merchandise Authorization (“RMA”) from our customer service team within the applicable Warranty Period of the date on which you received the Teforia Infuser or Accessory.

•   To request an RMA, you must contact our customer service team via our website at http://help.teforia.com or via email addressed to [email protected], and we will send you a prepaid shipping label.

•   If you are returning the Teforia Infuser, you must also include any Accessories originally included with the Teforia Infuser you purchased.

•   Teforia requires that you furnish a receipt or proof of purchase in order to obtain an RMA.

•   The returned Teforia Infuser and/or Accessory must be in good physical condition (not physically broken or damaged), in either the original packaging or packaging that provides an equal degree of protection.

•   If your claim is justified based on this Limited Warranty, Teforia shall bear the shipping costs associated with shipment of the repaired or replacement Teforia Infuser or Accessory to you. Any Teforia Infuser and/or Accessory that is returned to Teforia without a valid warranty claim or without an RMA may be rejected, returned to you at your cost (subject to prepayment) or kept thirty (30) days for your pick-up and then disposed of in Teforia’s sole discretion.

3. Exclusions

This Limited Warranty does not apply to a Teforia Infuser or Accessory that has been altered or modified by anyone who is not a representative of Teforia, or that is used outside the permitted or intended uses described by Teforia, or with a Teforia mobile application that has been altered or modified by anyone who is not a representative of Teforia. In addition, this Limited Warranty does not apply to: (a) consumables (such as included tea servings); (b) damage caused by use with non-infusible, inorganic material or overfilling the infusion globe; (c) damage caused by use of the Teforia Infuser or Accessory with liquids or herbal products other than tea; (d) damage caused by accident, abuse, misuse, ordinary household use or other external causes; (e) damage caused by operating the Teforia Infuser or Accessory outside of the permitted or intended uses described by Teforia in the help section of the Teforia website or with improper voltage; or (f) damage caused by service performed by anyone who is not a representative of Teforia. This warranty is void if a Teforia Infuser and/or Accessory is returned with removed, damaged or tampered labels or any alterations. If you have any questions about whether a use of your Teforia Infuser or Accessory is within the permitted or intended uses described by Teforia, you should contact Teforia at [email protected] before you engage in such use.

4. Limitations

This Limited Warranty applies only to the Teforia Infusers and Accessories manufactured by or for Teforia that can be identified by the “Teforia” trademark, trade name or logo affixed to it. The Limited Warranty does not apply to any software, even if packaged or sold with the Teforia Infuser or embedded in the Teforia Infuser. Please refer to the Terms of Service that accompany the Teforia mobile application for details of your rights with respect to use of the Teforia mobile applications.

Teforia does not warrant that the operations of the Teforia Infuser will be uninterrupted or error-free. Teforia is not responsible for damages arising from failure to follow instructions relating to the Teforia Infuser’s use.

No Teforia reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

5. Implied Warranties and Conditions

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES AND CONDITIONS (INCLUDING WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON THE DURATION OF AN IMPLIED WARRANTY OR CONDITION, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

6. Limitation of Damages

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, TEFORIA SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, EVEN IF TEFORIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL OR EQUITABLE THEORY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

7. Governing Law

This Limited Warranty shall be governed by the laws of the State of California, USA, without giving effect to any conflict of laws principles that may provide for the application of the law of another jurisdiction.

8. National Statutory Rights

Consumers in some jurisdictions may have legal rights under applicable national legislation governing the same of consumer goods, including, without limitation, national laws implementing EC Directive 99/44.
